Please note the Founders’ Club terms and conditions document is in addition to our standard terms and conditions/privacy policy.

1.       These terms govern the sale of the Founders’ Club packages by us and form the basis of the contract between us (Retribution Distilling Company Ltd) and you (Founders’ Club Member).

2.       You must read these terms and conditions - they have been kept short/concise to clearly state what we will provide, how we will provide it, and steps to take if there is a problem.

3.       If there is an issue with the product that you have purchased please just get in contact with us, we are a small company simply trying to make the best products and give the best service we can.

1.       The contract

1.1.   Age restrictions – by placing an order you are confirming that you are aged 18 years or over in the UK or are of legal age in your country of residence.

1.2.   Confirmation of application. Your application for either the Bronze, Silver or Gold Founders’ Club Membership will only be confirmed once payment has been received. Once payment is confirmed you will receive a confirmation/welcome email, this will typically be with in 48 hours of payment being made however them may take up to 5 days. You are responsible for ensuring all information provided is complete and correct on the application.

1.3.   Refusal. We reserve the right to refuse or cancel any order. Any orders refused/cancelled will be refunded within 14days.

1.4.   Founders’ Number. Your number will be assigned once your order has been confirmed

1.5.   Founders’ online page. Your name will appear on the Founders’ page with in 28 days of your order being confirmed, if you wish to opt out of the founders’ page please inform us in writing or via email.

1.6.   Buying a package as a gift. The person receiving the gift must be over 18 years of age if a UK resident or of legal age in country of residence. It must be clearly started in the comments that the package has been purchased as a gift. You must also ensure all information provided is correct for the person receiving the gift.

1.7.   Transferring a package. It is possible and any transfer must be confirmed in writing prior to it taking place. If a new membership card is required it can be provided at cost plus postage and a small administration fee.

2.       Payment

2.1.   All payments for packages will be via Stripe/Paypal/or bank transfer. Any international bank fees/charges must be covered by you the Founder. Membership will not be confirmed until payment is made in full.

3.       Pricing and availability

3.1.   All website pricing information is correct at the time of the Founders’ club launch. We reserve the right to change the pricing at any time or remove products or services without notice.

3.2.   The price displayed at checkout will always be the correct price.

3.3.   We reserve the right to limit sales to any one person, household, email address.

3.4.   We reserve the right to change pricing and description of products without notice and at any time.

3.5.   Membership price. Price depends on Founders’ Club package; Bronze £50, Silver £195, Gold £500 and are inclusive of VAT, duty. Theses package prices only include postage to UK addresses.

4.       Products

4.1.   Confirmation email. This email will contain information relevant to the membership package purchased along with membership number, and personal discount code/gift voucher for web shop if applicable.

4.2.   Membership card and new make spirit sample. New make spirit production began on the 1st July. It is hoped we will have new make spirit ready to post out by the 1st August. Membership cards and new make spirit samples will be sent within 6 weeks of Founders membership purchase. However, if delays in production occur this 6 week period may be extended. Updates will be sent via email to all founders’ members. We are not responsible if a membership card is lost, stolen, destroyed or used without permission. You must let us know if your card is lost or stolen. We can replace a lost or stolen membership card but you will be charged the cost of the replacement plus postage. We reserve the right not to accept any cards that have or appear to have been forged, damaged, defaced or otherwise tampered with.

4.3.   Personal discount code (Gold members only). You will receive a personal discount code, this code is linked to you the Gold Founders’ Club member, and can only be used by you, goods can only be posted to the address linked to the member account, unless by prior arrangement. We reserve the right to refuse the use of the discount code or withdraw the discount code if we believe it is being used inappropriately. The personal discount code does not apply to the purchase of private casks.

4.4.   Gift Vouchers. If applicable (silver and Gold packages only) will be sent out with the confirmation email, the voucher will be in the form of a unique code that can be used at the check out. Gift vouchers cannot be exchanged for cash and cannot be used in conjunction with other offers or discounts, nor can they be used for cask purchases. Gift vouchers do not expire. We are not responsible if a Gift Voucher is lost, stolen, destroyed, or used without permission and no replacement will be provided in these circumstances. We reserve the right not to accept any vouchers that have or appear to have been forged, damaged, defaced or otherwise tampered with.

4.5.   Gold membership cask discount. A 5% discount will be available to Gold Founders’ members on the purchase of a private cask. Further information on this will be released in early 2022.

4.6. Gold membership distillery tour. To be arranged at a time convenient to both parties. To include a tour of the distillery and cask ware house with a tasting from several casks. Founders’ member is responsible for all travel and accommodation costs, Retribution Distilling is only providing the distillery tour.

5.       Alcoholic samples/products

5.1.   Bronze Founders’ membership. A 10cl sample of new make spirit (2 x 5cl bottles) will be posted out within 6 weeks of the confirmation of membership purchase.  A 10cl sample of single malt whisky from cask 001 (2 x 5cl bottles) will be posted after a minimum 3 years maturation but could be as long as 5 years. The maturation time will be determined by us and we have finally say as to when the spirit is ready.

5.2.   Silver Founders’ membership. A 20cl sample of new make spirit will be posted out within 6 weeks of the confirmation of membership purchase.  A 70cl bottle of single malt whisky from cask 001 will be posted after a minimum 3 years maturation but could be as long as 5 years. The maturation time will be determined by us and we have finally say as to when the spirit is ready.

5.3.   Gold Founders’ Membership. A 20cl sample of new make spirit will be posted out within 6 weeks of the confirmation of membership purchase. A 10cl sample (2 x 5cl bottles) of maturing spirit from cask 001 at 1 and 2 years of age will be sent out at 1 and 2 years after the cask is laid down for maturation. A 70cl bottle of single malt whisky from cask 001 will be posted after a minimum 3 years maturation but could be as long as 5 years. A 2nd 70cl bottle from an early cask release will also be sent out at some point 3-5 years after it has been laid down. It will be form a early fill cask and will be something a bit special.  All maturation times will be determined by us and we have finally say as to when all spirits are ready. Gold Founders’ members will automatically be entered into a draw for bottle 001 from cask 001.

5.4.   Whisky will be bottled after the minimum legal maturation term of three years has elapsed and has reached maturation. The point of maturation will be determined by us and is anticipated to be between three and five years from the date of cask filling.

5.5.   We will endevour to deliver the new make spirit samples as set out above. We will endevour to deliver the whisky as set out above following the relevant maturation periods. Once bottle the spirit will be posted out within 4 weeks.

5.6.   Production will commence on the 1st July however we cannot be held accountable for any delays in production.

5.7.   Bottling alcoholic strength will be determined by us prior to bottling.

5.8.   Every reasonable effort has been made to ensure that all descriptions of goods for sale from us match the actual goods you receive, we cannot be held responsible for variations from such descriptions. This refers only to variations of the correct goods, not different goods altogether.

6.       Delivery

6.1.   Goods will be delivered to the delivery address supplied at the time of the order unless you have notified us of a change of address. It is your responsibility to ensure the correct information is provided. We cannot accept any liability for late or failed delivery if the quoted address is incorrect or incomplete. You will be liable for any additional delivery costs resulting from a change of address and these must be paid for in full prior to the goods being dispatched. You can notify us of a change of address by emailing us at rich@retributiondistilling.co.uk  We cannot deliver to PO boxes.

6.2.   Delivery charges to UK addresses are included in the Founders’ Club packages

6.3.   Non-UK deliveries. International orders are subject to international delivery charges and you are responsible for those charges. Founders will be invoiced for non-UK delivery charges prior to shipping each of goods. We will only ship goods once payment has been made.

6.4.   Extra costs associated with non-UK delivery. Deliveries to non-UK addresses may incur extra charges which you must pay to receive your goods. Charges may include, but are not limited to, import duties and taxes applied when the delivery reaches its destination and administration charges imposed by foreign customs authorities or by delivery agents. These charges are outside of our control, please research associated costs prior to ordering.

6.5.   Due to country-specific restrictions we cannot ship to the following countries: USA, Canada, Turkey, UAE, Russia, Egypt, Mexico, Indonesia, Vietnam, Brazil, Iran, Iraq, North Korea, Mongolia, Ukraine, Chad and Niger. This list is not exhaustive; if you are ordering from outside the UK, please contact us prior to ordering to confirm if we can.

6.6.   We will not be liable for a failure to perform, or delay in performance of, any of our obligations that is caused by circumstances or events beyond our control. If such circumstances continue for a period of longer than 6 months then you have the right to terminate the contract.

6.7.   Failed delivery. If goods are returned to us due to non-delivery, we will attempt to contact you by email or telephone to arrange re-delivery at your expense. If we are unable to make contact with you following all reasonable attempts we shall be entitled to dispose of the undelivered goods as we see fit without liability to you and we shall be released from any future liability to deliver any remaining outstanding goods in connection with your package.

7.       Returns Policy

7.1.   If you have changed your mind. As you are a consumer you have a legal right to change your mind within 14 days of receiving the Order confirmation (“the cooling-off period”) and receive a refund, in accordance with the Consumer Contracts Regulations 2013. No refunds can be given after the 14 day cooling off period has elapsed except where goods we supply you are faulty, damaged or incorrect.

7.2.   Cancelling your order. If you have changed your mind and wish to cancel your order within the cooling off period, please let us know by email at rich@retributiondistilling.co.uk quoting your Founders’ Club membership number.

7.3.   Refunds. To be eligible for a refund you must return any goods in their original and sealed condition along with the original packaging. You will be responsible for paying the cost associated for returning your item. Once your return is received and inspected, we will notify you that we have received your returned item and whether you are entitled to a refund. If you are entitled to a refund we will refund the price you paid by the payment method used within 30 days of us notifying you of your entitlement to a refund. If you have used a gift card (silver and gold memberships) or discounts (gold members) this amount will be deducted from any refund issued.

8.       Faulty, damaged or incorrect goods

8.1.   Should you feel it necessary to return an item because it is faulty, different from its description at the time of purchase or different to what you ordered, please contact us at rich@retributiondistilling.co.uk within 14 days of delivery to inform us of the fault or error and to arrange a refund or replacement.

8.2.   Goods damaged in transit. We will take care when packaging items for shipping and we hope it arrives in perfect condition. Unfortunately, some parcels may incur damage while in transit. If a parcel shows clear signs of damage or leakage at the time of delivery, we suggest that you refuse the parcel, take photographic evidence and ask the courier to return the goods to sender. If you discover the goods are damaged after taking delivery, promptly notify us via email or in writing with photographic evidence of the damage no later than seven days after the date of delivery. Provided notification and evidence is received within this time, we will replace the damaged goods where a replacement is available and bear the associated costs. Where replacement goods are not available, for example, Cask 001, we will refund you the recommended retail price.

9.       Other Terms

9.1.   We reserve the right to make changes to the specification of goods that may be required to conform to any applicable safety or other legal or regulatory requirements without notice.

9.2.   We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the Contract.

9.3.   You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing. We may not agree if that person is an existing Founder.

9.4.   This Contract is between you and Retribution Distilling Company. No other person shall have any rights to enforce any of its terms, except as explained in clauses 9.2 and 9.3. We will not need to get the agreement of any other person in order to end the contract or make any changes to these terms.

9.5.   Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

10.   Privacy

10.1.   We will use the personal information you provide to us: to supply the goods to you; to process your payment; and if you agreed to this during the order process, to give you information about similar products that we provide, but you may stop receiving this at any time by contacting us.

10.2.  We will only give your personal information to third parties where the law requires us to do so. For more information please see our Privacy Policy.
